TERMS AND CONDITIONS

Please read this document carefully.

These conditions have been in force for all Customers since January 15, 2023.

We try to keep our general terms and conditions of contracting and use as clear as possible, and provide you with all the necessary information about online transactions in our store so that you can easily understand the entire process, from ordering, delivery/collection and a possible return.

It is very important to us that your online shopping experience meets your expectations, so we would appreciate it if you take a few minutes and continue reading. When making or registering a purchase, you accept our general terms and conditions of contracting and use.

Please note that there are different terms for purchases in our “physical” stores (including prices, service fees, availability, delivery time and return policies), please consult them in one of our stores.

Definitions

For the purposes of these terms and conditions, this means:

1. Domain www.galerianicolaunasoni.pt

1.a) The website : www.galerianicolaunasoni.pt is owned by Galeria Nicolau Nasoni Lda, with registered office at Rua de Costa Cabral 1940, 4200-216 Porto, legal entity 516 277 014, with share capital of €125,000.00.

1.b) Seller : Galeria Nicolau Nasoni Lda. is the owner of all items available on the website www.galerianicolaunasoni.pt.

1.c) Client: singular person or collective with legal capacity who intends to purchase movable goods whose sale is carried out in accordance with the rules of Galeria Nicolau Nasoni Lda.

2. Object and scope of application

2.a) These general terms and conditions of contracting and use apply to visitors to the website www.galerianicolaunasoni.pt and to any transactions of a commercial nature carried out through the online store of Galeria Nicolau Nasoni Lda. as well as making available and defining all the information customers need about sales, ordering, payment and delivery methods for purchases made on our website.

2.b) The works of art advertised and sold on www.galerianicolaunasoni.pt are the sole responsibility of the Seller, particularly with regard to their ownership, quality, safety, origin, guarantee and compliance with applicable legislation.

2.c) The operations carried out are concluded directly between the Seller and the customer, in compliance with the precepts and other legal requirements in force.

3. Security conditions

Galeria Nicolau Nasoni Lda. is committed to respecting the personal data of all users of its website and is committed to protecting all personal information that each user decides to place there.

There may be areas of the website that can be accessed without the user providing any personal information. However, when the collection of data becomes necessary for the supply/availability of products, or if the user decides to provide their personal data, the collection and use of these will comply with the criteria of the legislation applicable to the protection of personal data - General Regulation on Data Protection – so that the confidentiality and security of the personal data provided is ensured.

Galeria Nicolau Nasoni Lda. reserves the right, without the need for prior notice, to change and update security procedures, always in full respect of the rights of data subjects and guided by the principle of responsibility set out in the GDPR. Despite the security procedures mentioned above, there are risks when using the Internet, over which Galeria Nicolau Nasoni Lda. has no control and which require permanent attention and care from data subjects.

4. Conclusion of the purchase and sale contract

4. a) The works of art are presented on the Website with a description that allows the customer to know their essential characteristics and their price.

4. b) The Member selects the items they wish to purchase.

4. c) Confirm your choice(s) and accept these terms by clicking on validation.

4. d) The customer makes the payment for the item(s).

4. c) The customer receives an email message confirming acceptance of their order.

4. d) The seller sends the order to the customer's address as quickly as possible.

4. e) The customer must confirm receipt of the item(s), their conformity and their condition.

4. f) In the absence of confirmation, works of art are presumed to have been received and in good condition within 15 (fifteen) days from the date of dispatch.

5. Products, Prices and Payments

The price is indicated in euros with all taxes and fees included in the description sheet.

Galeria Nicolau Nasoni, Lda. reserves the right, at any time, to replace or modify the available products, their respective prices and the conditions presented, safeguarding orders already placed. Galeria Nicolau Nasoni, Lda. makes every effort to ensure that the information presented is free from typographical errors (in the descriptions, characteristics, values and/or images/photographs of the products) and, whenever these occur and are detected, it will proceed with correction immediately. The sales price for the product in question is defined and indicated by Galeria Nicolau Nasoni, Lda.

6. Orders

The user can place their order online, at www.galerianicolaunasoni.pt. Orders at the Galeria Nicolau Nasoni, Lda. online store can be placed 24 hours a day, 7 days a week.

While browsing the store, you can add to the shopping cart by clicking the “buy” button. When you have finished selecting the products, you can select the “Continue to order” option to make the purchase. In the “delivery location” field, you can choose to collect from one of our Galeria Nicolau Nasoni stores, or deliver to an address you indicate.

After entering your personal details, you will be asked to confirm them and also confirm your intention to place the order. Once confirmed, the order will be sent to the selected delivery location. You will receive an email confirming acceptance of the order by Galeria Nicolau Nasoni, Lda. Once your order has been accepted, you will be informed of the reference that will allow you to track the delivery of the products.

7. Order delivery

Small orders (up to 20kg) will normally be delivered by courier (DPD) between 8am and 7pm on weekdays, or by freight forwarders for large orders (more than 20kg), in the morning between 8am hours and 2 pm and in the afternoon between 2 pm and 8 pm, Monday to Friday.

For orders paid by Bank Transfer, Credit Card, ATM, MBWAY, the shipping period will, in principle, be up to 24 hours on working days, from the date of receipt and confirmation of payment of the order by Galeria Nicolau Nasoni, Lda.

Delivery will be made upon signature of the receipt, by anyone who is at the indicated address and who is, from that moment on, responsible for delivery to the Customer. If no one is found at the address indicated, delivery will be attempted again at the address mentioned above for 3 working days, after which it will be returned to Galeria Nicolau Nasoni, Lda. For orders returned to Galeria Nicolau Nasoni, Lda. it will be scheduled new delivery, which is paid for by the Customer.

Payment can be made at the time of order confirmation via ATM, Credit Card - VISA/MasterCard (subject to confirmation) and Bank Transfer.

8. Payment methods

Galeria Nicolau Nasoni, Lda., in its online store has several payment options for your order:

Credit card (Visa and MasterCard) - The Customer will have to enter/enter all requested data. If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of Galeria Nicolau Nasoni, Lda).

MBWay - The Customer will have to enter the mobile phone number associated with MBWay and confirm the respective payment in the MBWay application. If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of Galeria Nicolau Nasoni, Lda).

Multibanco - You have 12 hours after placing your order to make the payment at an ATM (Multibanco) or home banking, using the data provided in your order confirmation (entity/reference/amount) and sent to the email address of registration. This data is also saved in the customer account under “orders”. If payment is not made after the 2nd day, the order will be cancelled.

Bank transfer - You have 24 hours after placing the order to make the payment at an ATM (ATM) or home banking, using the data provided in your order confirmation (IBAN/BIC/SWIFT and value) and sent to e -registration email. This data is also saved in the customer account under “orders”. If payment is not made after the 5th day, the order will be cancelled.

9. Premium Delivery

The Premium Delivery service is a personalized service that includes personalized delivery at the time and day to be agreed between the customer and Galeria Nicolau Nasoni, Lda. This service was created to facilitate deliveries on days when the customer can receive them outside the working hours and days. This service will have to be scheduled with our customer support by contacting us via email: galerianicolaunasoni@gmail.com or by contacting 926511070. This type of service has an additional cost depending on your location.

10. Damage during transportation

Small items (up to 20kg), normally delivered by courier (DPD):
Upon delivery, check the condition of the packaging.
If it presents any anomaly (damaged, wet, torn box,...), you must REFUSE the order (in this case, without opening it).
If you decide to accept the order, you must request the delivery sheet from the courier and place what you can visually verify on the packaging and also write "reservations at the time of delivery, subject to verification".

Large items (> 20Kg), normally delivered by freight forwarders:
ALWAYS ask for the item(s) to be unpacked.
Check whether the item(s) has any visible exterior and/or interior cosmetic damage. If so, DO NOT accept it(s).

If the item is not in perfect condition, you must refuse the item upon delivery.

When picking up an item
When picking up, check the condition of the packaging. If it presents any anomaly (damaged, wet, torn box...), you must refuse the order (in this case, without opening it).

If the item is not in perfect condition, you must refuse it at the time of collection.

11. Termination of the contract

The Customer has, under applicable law, the right to terminate the contract (without payment of compensation and without the need to indicate the reason), which must be exercised by email, letter or telephone to Customer Support www.galerianicolaunasoni.pt within 14 days from the date of receipt of the order (article 10, no. 1 of DL 24/2014 of 14 February).

Items must be returned within 14 (fourteen) days after communication of the decision to terminate the contract and accompanied by the original invoice (article 13, no. 1 of DL 24/2014 of 14 February).

If the right to free resolution is exercised within the aforementioned period, only the price of the Product(s) purchased and shipping costs will be refunded, within 30 (thirty) days. Return costs are borne by the Buyer, with exceptions. If you wish to exchange or return items, you can go to any Galeria Nicolau Nasoni, Lda store, or contact Customer Support 926511070 who will provide you with all the information about the exchange/return process. Under no circumstances can items be sent without prior contact as they will not be received.

The return and exchange of items must comply with the following conditions:

  1. Return of items in good condition, with complete original packaging and accompanied by the respective invoices;

Galeria Nicolau Nasoni, Lda. does not accept the return or exchange of:

  1. Damaged items.

After contacting Galeria Nicolau Nasoni, Lda. Customer Support and having been given return instructions, you can send us the properly packaged item, with original packaging, to the following address:

All items will be checked upon arrival at our service and only those that comply with the return conditions will be accepted for exchange or return.

If you choose to refund the amount, we inform you:
Refunds are made using the same method in which the payment was made. In the case of payment by Bank Transfer, we ask that you provide us with an IBAN (international bank account number).

The refund will only be made within a maximum period of 30 days from the date of receipt of the free resolution communication.

Galeria Nicolau Nasoni, Lda reserves the right not to accept items that do not comply with these conditions.

12. Final provisions

Galeria Nicolau Nasoni, Lda may send the Customer information about new products, promotions or others of interest to Online Store Customers.
